1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Agreement" means these Terms and Conditions together with any engagement letter or service agreement between the parties.
- "Services" means the legal services described on this website, including initial consultation and records inventory, beneficiary designation update, and administrative court litigation.
- "We / Us / Our" means Garuda Legal, a legal practice operating from 78 Phahonyothin Road, Chatuchak, Bangkok 10900, Thailand.
- "You / User" means any individual who accesses this website or engages our Services.
- "Content" means all text, information, materials, and documents published on this website.
2. Acceptance of Terms
By accessing this website or engaging our Services, you confirm that you have read, understood, and accept these Terms. You must be at least 18 years of age and have the legal capacity to enter into binding agreements. If you are acting on behalf of another person, you confirm that you have authority to do so.
3. Service Description
Garuda Legal provides legal counsel focused on pension-related matters in Thailand. Our three primary services are:
- Initial Pension Consultation and Records Inventory — a two-hour consultation with a senior lawyer to review and categorise pension documents, priced at 4,200 THB.
- Pension Beneficiary Designation Update — a focused engagement to update named beneficiaries on pension and social security accounts, priced at 4,800 THB (third-party costs such as notarisation charged at cost).
- Litigation Against Pension Authority Decisions — full representation in Thailand's administrative court system, priced at 14,800 THB (court filing fees and expert costs charged separately and itemised in advance).
Services are provided in Bangkok, Thailand, and are primarily relevant to matters governed by Thai law. We do not represent clients in matters before foreign courts or regulatory bodies.
4. User Responsibilities
When engaging our Services or using this website, you agree to:
- Provide accurate, complete, and up-to-date information when requested
- Inform us promptly of any changes to information relevant to your matter
- Not submit fraudulent, misleading, or illegally obtained documents
- Not use this website for any unlawful purpose
- Not attempt to interfere with or compromise the security or integrity of this website
- Treat our staff and counsel with respect during all interactions
5. Intellectual Property
All content on this website — including text, design elements, and structure — is owned by or licensed to Garuda Legal. You may view and print content for your personal, non-commercial reference only. You may not reproduce, distribute, or use any content for commercial purposes without our written permission.
Documents prepared by Garuda Legal on your behalf (written summaries, court filings, correspondence) are provided for your use in connection with your matter and may not be reproduced for commercial purposes or presented as independent legal advice.
6. Payment Terms
Fees are payable in Thai Baht (THB). The following conditions apply:
- Consultation and beneficiary update fees are due in advance of the service being performed
- For litigation engagements, fee payment terms will be set out in the engagement letter
- Third-party costs (court filing fees, notarisation, expert witness fees) are itemised before being incurred and invoiced at cost
- Payment methods accepted include bank transfer and cash; we will confirm accepted methods on engagement
- Refunds: Consultation fees are non-refundable once the session has taken place. If a consultation is cancelled with at least 48 hours' notice, a full refund will be provided. Litigation engagement fees paid in advance may be refunded on a pro-rata basis for work not yet performed if the engagement is terminated.
7. Service Delivery Terms
- Written summaries following a consultation will be provided within two working days of the session
- We will respond to all client enquiries within one working day during office hours (Monday–Friday 9:00–17:30, Saturday 10:00–13:00)
- Timeline estimates provided for litigation matters are indicative; court timelines are subject to factors outside our control
- We will notify you promptly of any development that may affect timelines or costs
- Family members may attend consultations without prior notice
8. Confidentiality
We maintain strict attorney-client confidentiality over all information shared with us in the course of a legal engagement. Information shared during an initial consultation prior to formal engagement is also treated as confidential. We will not disclose your information to third parties except as described in our Privacy Policy or as required by law or our professional obligations.
9. Disclaimers
The content on this website is provided for general information purposes only and does not constitute legal advice. Legal advice is provided only through a formal engagement. We do not warrant that the information on this website is accurate, complete, or current at all times.
We cannot predict or warrant specific outcomes in any legal matter. Assessments of the strength of a case or likely timelines are opinions based on the information available at the time and may change as circumstances develop.
10. Limitation of Liability
To the extent permitted by Thai law, our total liability to you in connection with any matter shall not exceed the total fees paid to us in that matter. We shall not be liable for indirect, consequential, or incidental losses, including lost income or reputational harm, arising from our Services or from the use of this website.
We are not liable for delays or failures caused by events beyond our reasonable control, including court scheduling delays, government office processing times, or force majeure events.
11. Indemnification
You agree to indemnify and hold Garuda Legal harmless from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your provision of inaccurate or misleading information, or your unlawful use of this website or our Services.
12. Termination
Either party may terminate a service engagement on written notice. On termination, fees for work completed to that point remain payable. We reserve the right to terminate an engagement if continued representation would conflict with our professional obligations or ethical requirements under the Lawyers Council of Thailand.
Provisions relating to confidentiality, intellectual property, limitation of liability, and dispute resolution survive termination.
13. Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, the parties agree to first attempt resolution through good-faith discussion. If resolution cannot be reached informally within 30 days, disputes shall be submitted to the jurisdiction of the Thai courts in Bangkok.
14. General Provisions
- Entire agreement: these Terms, together with any engagement letter, constitute the entire agreement between the parties for website use and service delivery
- Severability: if any provision is found unenforceable, the remaining provisions continue in full force
- Waiver: failure to enforce any provision does not constitute a waiver of the right to enforce it in future
- Assignment: you may not assign your rights under these Terms without our prior written consent
- Notices: formal notices should be sent to [email protected] or by post to our Bangkok office address
15. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page. For active client engagements, material changes will be communicated directly. Continued use of this website after an update constitutes acceptance of the revised Terms.
